1. Scope
These Terms of Service govern your use of the CashColt service (the "Service"), operated by Cosmic Drift Game Studio, Marc Frost, Slevogtstr. 10, 04159 Leipzig, Germany (the "Provider"). By registering for or using the Service, you accept these Terms.
2. Service Description
The Service provides online calculators for loans and mortgage financing — in particular amortization schedules, extra-payment and fixed-interest-period calculations and related analyses. The feature scope depends on the selected plan. The Provider continuously develops the Service and may change, add or discontinue features.
3. No Financial, Tax or Legal Advice
The calculators, results and analyses of the Service are provided solely for non-binding orientation and illustration. They do not constitute financial, investment, tax or legal advice and are no substitute for it. All calculations are provided without warranty as to accuracy, completeness or fitness for a particular purpose; they are based on the assumptions you enter and on simplified models. Actual lender terms may differ. Do not make financial decisions based on these results alone — seek qualified advice (e.g. a bank, tax or financial advisor) beforehand.
4. Registration and Account
An account is required to use the Service. You provide accurate information, keep your credentials confidential and notify us without undue delay if you suspect misuse of your account. You are responsible for all activity under your account.
5. User Obligations
You will not use the Service unlawfully or abusively, will not distribute malware and will not impair the operation of the Service (e.g. by automated mass requests). You are solely responsible for the data you enter.
6. Availability
The Provider strives for high availability but does not warrant it. In particular, the free plan carries no entitlement to any specific availability (no SLA). Maintenance, incidents or circumstances beyond the Provider's control (e.g. outages of sub-processors) may cause interruptions.
7. Pricing and Payment
Paid plans are billed at the prices shown in the Service. Payments are processed by our payment provider (Stripe). As a small business (§ 19 UStG), no VAT is charged and therefore not shown. Payments for current billing periods are not refunded on a pro-rata basis except where required by mandatory law.
8. Term and Termination
The contract runs for an indefinite period. Free accounts may be terminated by either party at any time without notice. Paid subscriptions may be cancelled effective at the end of the respective billing period. The right to extraordinary termination for cause remains unaffected. The Provider may suspend or terminate accounts that violate these Terms.
9. Liability
The Provider is liable without limitation for damages arising from injury to life, body or health and for intent and gross negligence. For slightly negligent breach of a material contractual obligation (cardinal obligation), liability is limited to the foreseeable damage typical for the contract. Otherwise, liability for slight negligence is excluded. Liability for financial decisions based on the Service's calculation results is excluded in accordance with Section 3. Liability under the German Product Liability Act remains unaffected. For services provided free of charge (free plan), the Provider is liable only for intent and gross negligence.
10. Warranty
The Service is provided "as is". To the extent permitted by law, the Provider does not warrant that the Service is uninterrupted, error-free or fit for a particular purpose.
11. Data Protection
Information on the processing of personal data is available in our Privacy Policy.
12. Changes to the Terms
The Provider may amend these Terms with effect for the future, e.g. due to changes in the law or feature scope. You will be informed of material changes in good time together with information on your right to object and the consequences. If you do not object within a reasonable period or continue using the Service, the amended Terms are deemed accepted.
13. Final Provisions
German law applies, excluding the UN Convention on Contracts for the International Sale of Goods. If you are a merchant, a legal entity under public law or a special fund under public law, the place of jurisdiction is the Provider's registered seat. Mandatory consumer-protection provisions of the country of your habitual residence remain unaffected. Should any provision be invalid, the validity of the remaining provisions remains unaffected.
14. Right of withdrawal for consumers
If you are a consumer and purchase a paid plan online, you have a statutory right of withdrawal. You may withdraw within 14 days without giving reasons. The period starts on contract conclusion. Send a clear statement to hello@kumiko.rocks.
Digital content: If you expressly agree that we begin performance before the withdrawal period ends and confirm that you lose your right of withdrawal once performance is complete, the right expires when performance begins, where permitted by law.
